This Limited Engagement Agreement ("Agreement") is entered into between Stone Canyon Law, PLC, d/b/a Collections Law Group ("the Firm"), located at 502 S. College Ave #205, Tempe, AZ 85281, and the client identified below ("Client").
1. Scope of Representation. The Firm agrees to represent Client in connection with an initial collections demand campaign against the debtor(s) identified in the submitted case. The Firm's representation is limited exclusively to: (a) sending one or more written demand letters; (b) making telephone calls and sending written communications to the debtor(s) in furtherance of collection; and (c) negotiating a resolution on Client's behalf. This Agreement expressly EXCLUDES the filing of any lawsuit, arbitration proceeding, or any other formal legal proceeding. If litigation becomes necessary, a separate engagement agreement will be required.
2. Fee. In consideration for the Firm's services, Client agrees to pay a contingency fee of 33⅓% of all gross amounts recovered on behalf of Client under this Agreement. No fee is earned if nothing is recovered. Client is responsible for actual out-of-pocket expenses (postage, printing at $0.10/page, database searches, and similar costs) regardless of outcome.
3. Termination of Engagement. This engagement terminates upon the earliest of: (a) settlement or recovery of the debt following the demand campaign; (b) conclusion of the demand campaign without settlement; or (c) the matter proceeding to litigation, at which point a new engagement agreement is required.
4. Client Responsibilities. Client agrees to provide truthful and complete information about the debt and the debtor, to promptly respond to requests for additional information, and to notify the Firm of any direct contact by the debtor.
5. FDCPA Notice. This Firm is a debt collector. Any information provided may be used for that purpose. Collections Law Group complies with the Fair Debt Collection Practices Act. No representation is made that the debt will be collected.
6. No Guarantee. The Firm makes no representation or guarantee that the debt will be collected. The outcome of any collection effort depends on factors outside the Firm's control.
7. Governing Law. This Agreement is governed by the laws of the State of Arizona.
By typing your full legal name below, you acknowledge that you have read, understood, and agree to this Agreement, and that your typed name constitutes your electronic signature under applicable law including the Electronic Signatures in Global and National Commerce Act (E-SIGN).
Your electronic signature will be recorded with the date, time, and IP address of this submission as required by the E-SIGN Act. By signing, you confirm you are authorized to enter into this agreement on behalf of the Client.
